Local 9404 Grievance Strike

Sisters and Brothers,

Urgent News:

You may be hearing rumors that Local 9404 went on strike.

The rumors have been substantiated and the limited information is Local 9404 went out on a GRIEVANCE STRIKE to resolve some grievances/issues in their Local.

At this time Local 9416 is not involved in this action by Local 9404.

With the expiration of the contract, we currently do not have any arbitration rights for grievances that may arise while we are working without a contract and a grievance strike is protected activity under Federal law.

We will provide additional information when we receive it.

I heard 2 of our guys got suspended today for refusing OT…. may i ask, what are we waiting for?

Ok, Im from 9404 .AT 9am I got a call from my union steward that we have gone on strike and to report back to the yard to turn in my truck. The story goes that 2 mst refused to work ot after their 8 hour shift and was given an occurance for it.Followed was the grievance and the strike. Now the grievance has been settled and we are now to return to work.I don’t know if this was supposed to start the whole company strike but after reading other locals websites they didn’t have the Authority to follow.As we left the yard our supervisors said we would be disciplined. The Local presdinet came down to our picket and said it was total legal and the company could do nothing to us.
Our local is pretty diverse in area but is mostly I&R ,mst,construction and frames . Our brothers and sisters went out with pride and stood our ground. We all hope for a fair contract and to get our lives back normal soon.

I am happy to hear that this was finally settled. In Cali, you can’t be forced to work o.t. ……there is a thing called labor law…….i know that techs are told to work everyday. I am proud that all you techs are standing your ground and sayin NO to the overtime at this moment.

why don’t we have arbitration rights? all of our other rights are there.

Do the labor laws state that we cannot be forced to work OT? Seems like I remember being force a lot in the business office before the MOA came down against it. When I called my local to ask about this action I was told the MOA expired a couple of years ago and that the company is only supposed to call for forced OT in the case of extreme circumstances. “Needs of the business” ring any bells? Seems like what they used in every circumstance back in those days.

I am extremely proud of the members of 9404 for standing up for their brothers. It is time for us to take a stand and get this thing done. I feel like we are in a holding pattern. I want life to get back to normal again!!!
